📄 Intellectual Property & License Terms — LW Media

Effective Date: March 2026

These terms apply to all photo and video services provided by LW Media unless otherwise agreed in writing.

All photo and video content created by LW Media remains the intellectual property of LW Media and is protected under Canadian copyright law.

Content is licensed, not sold, and usage is granted under the following terms:

1. Standard License (Included)

The client is granted a non-exclusive, non-transferable license to use delivered photo and video content for:

  • MLS listings and Realtor.ca
  • Marketing of the specific property listing
  • Social media and agent branding related to that listing

This license is limited to:

  • The original listing agent and/or their brokerage
  • Use is valid only while the property is actively listed by the original agent
  • The specific property photographed/filmed

2. Restrictions

Unless otherwise agreed in writing, the following are not permitted:

  • Transfer, resale, or distribution to third parties (including other agents, brokerages, builders, or marketers)
  • Use of content for additional listings or properties
  • Commercial resale or publication outside the intended listing
  • Use by third-party marketing agencies or media companies without written permission

3. Extended Media Usage License (Non-AI)

Use of photo or video content beyond a single property listing requires an Extended Media Usage License.

This includes:

  • Paid advertising beyond the promotion of a single property listing
  • Agent, team, or brokerage branding and marketing
  • Use across multiple listings or long-term campaigns

Extended Media License terms:

  • Non-transferable, including to third parties without additional licensing
  • Does not permit resale or redistribution
  • Does not include AI-generated content or synthetic media rights

4. AI Usage License (Separate Add-On)

Use of photo or video content in the following requires a separate AI Usage License:

  • AI-generated video or synthetic media
  • AI-enhanced marketing or generative content creation
  • Use in AI tools, platforms, or automated media systems

AI License terms:

  • Non-transferable, including to third parties without additional licensing
  • Does not permit resale or redistribution
  • Does not permit use for AI model training, datasets, or machine learning systems

5. Video Usage

Video content is licensed under the same terms as photography.

  • Editing, cropping, and platform formatting are permitted
  • Raw video footage is not included unless explicitly agreed
  • Re-editing by third parties requires written permission

6. Additional Licensing

Any usage outside the scope of the standard license—including reuse by another realtor, brokerage, or third party—requires additional licensing through LW Media.

7. Copyright

All content remains the exclusive property of LW Media at all times.

8. Acceptance of Terms

Use of any delivered media constitutes acceptance of these licensing terms.

Extended Media and AI Usage Licenses are available for all projects. Please contact LW Media for pricing.

📄 Additional Terms — Short-Term Rental (Airbnb / VRBO)

A non-exclusive license is granted to the client for use of the licensed images and video for short-term rental promotion of the property listed in the invoice.

Includes digital use across platforms such as Airbnb, VRBO, and social media.

This license is valid perpetually while the property remains under the same ownership and is used for short-term rental purposes.

Use is limited to the property owner or authorized property manager and is non-transferable.

No resale, transfer, or third-party use (including marketing agencies or media companies) is permitted without additional licensing.

Use of media in AI-generated content, synthetic media, or for AI model training is not permitted without an extended license.

All media remains the copyright of LW Media.

LW Media reserves the right to update these terms at any time. Continued use of delivered media constitutes acceptance of the current terms.
